With regard to rules on advertising likely to affect the opportunities for marketing imported products, the Court ruled in its Yves Rocher judgment that Article 30 precluded the implementation of a ban on price-based advertising in which the new price is highlighted against the previous higher price. Finally, the Commission is examining, in the light of the Court's new decisions, the compatibility with the Treaty of trading monopolies for tobacco products in certain Member States, while awaiting a decision on matters currently pending before the Court.
