La partie requérante reproche à la Commission, d’une part, que n’ayant pas accès à plusieurs documents administratifs, elle ne serait pas en mesure d’exercer utilement son droit de recours et, d’autre part, que la Commission aurait fait une interprétation erronée de l’article 106, paragraphe 2, TFUE en ne prenant pas en compte la condition d’efficacité économique dans la fourniture du service public, dans le cadre de son analyse de la légalité de la mesure litigieuse.
The applicant complains, first, that, not having access to several administrative documents, it was not in a position usefully to exercise its right of action and, secondly, that the Commission misinterpreted Article 106(2) TFEU by not taking account of the condition of economic efficiency in the provision of public service, in the context of its analysis of the legality of the contested measure.
