The Court considers that the Commission underestimated the importance of the cooperation of Daiichi and finds that the reduction granted to this company in accordance with section D of the Leniency Notice should accordingly be increased from 35% to 50%, the maximum allowable reduction under that section.

In comparison to the proposal presented by the Commission on PDAB 2/2005, the Council adopted in its Draft Amending Budget full salary adjustment for all institutions, including an additional reduction of EUR -8 875 971 in Section III (Commission) and of EUR -318 813 in Section VII (Committee of the Regions).

Notes that the Council continues to take an across-the board approach to heading 5 and that no options have been examined by that arm of the budgetary authority to solve the specific problems in each institution; points out that the Council's cuts in each section would have an adverse effect not only on the normal functioning of the institution concerned, but also on its capacity to prepare for enlargement, if left unamended; has decided, therefore, to apply a strategy in the "other sections" of re-entering appropriations to cover the most pressing needs in each section and offsetting them by other budgetary measures, thus minimisin ...[+++]g the budgetary impact on the margin left under the ceiling;

The Council decided that, instead of applying the proposed reduction rates to the various sections of the fleet on the basis of the stocks targeted, these rates should be weighted according to the composition of the vessel catches.

If cod and haddock make up a third of the total catch, the reduction rate applied to that section of the fleet is one third of 30%, or only 10%.
