Alors que les normes concernant le droit matériel se basent sur l’article 93 et donc sur le principe de l’unanimité, celles qui se rapportent au droit procédural, au droit administratif, au droit d’application, se basent sur l’article 95 parce que ceci nous permet entre autres de ne pas être liés à ce principe d’unanimité et facilite aussi, ainsi que nous l’avons vu ce matin en matière de services financiers, le progrès vers ce que la présidence espagnole appelle plus d’Europe.
Whereas the rules of substantive law have their base in Article 93 and, therefore, unanimity, those concerning formal law, administrative law and application law have their base in Article 95 because, amongst other things, this allows us to avoid unanimity and also paves the way, as we saw this morning in the field of financial services, for what the Spanish Presidency calls ‘more Europe’.
