(26) En vue de réparer le préjudice subi du fait d'une atteinte commise par un contrevenant qui s'est livré à une activité portant une telle atteinte en le sachant ou en ayant des motifs raisonnables de le savoir, le montant des dommages-intérêts octroyés au titulaire du droit devrait prendre en considération tous les aspects appropriés, tels que le manque à gagner subi par le titulaire du droit ou les bénéfices injustement réalisés par le contrevenant et, le cas échéant, tout préjudice moral causé au titulaire du droit.
(26) With a view to compensating for the prejudice suffered as a result of an infringement committed by an infringer who engaged in an activity in the knowledge, or with reasonable grounds for knowing, that it would give rise to such an infringement, the amount of damages awarded to the rightholder should take account of all appropriate aspects, such as loss of earnings incurred by the rightholder, or unfair profits made by the infringer and, where appropriate, any moral prejudice caused to the rightholder.
