En deuxième lieu, la Commission soutient que la note du 28 juillet 2009, que la requérante a intitulée « R[éclamation] » au sens de l’article 90, paragraphe 2, du statut, n’était qu’une simple demande visant à se faire communiquer des documents, et ne présentait pas le contenu minimum requis par la définition de la notion de réclamation administrative préalable au sens des dispositions du statut, raison pour laquelle cette note n’a pas pu avoir pour effet de suspendre le délai de trois mois et dix jours pour la saisine du Tribunal.
Secondly, the Commission contends that the note of 28 July 2009, which the applicant entitled ‘Complaint’ within the meaning of Article 90(2) of the Staff Regulations, was no more than a request for documents, and did not have the minimum content required for a ‘prior administrative complaint’ within the meaning of the provisions of the Staff Regulations, which is why that note did not have the effect of suspending the time-limit of three months and ten days before the matter could be referred to the Tribunal.
