La transmission de l'exécution d'une condamnation est subordonnée à l'accord de l'État de condamnation et de l'État d'exécution et ne peut intervenir par ailleurs qu'aux conditions cumulatives énumérées à l'art.5 de la Convention : a) le jugement est définitif et exécutoire ; b) les actes ou omissions qui ont donné lieu à la condamnation constituent l'une des infractions mentionnées à l'article 1 paragraphe 1 point a), au regard du droit de l'État d'exécution ou en constitueraient une s'ils intervenaient sur son territoire -« double incrimination »; c
