Pour apprécier si la combinaison de la forme et du dessin de la tablette litigieuse peut être perçue par le public comme une indication d’origine, il y a lieu d’analyser l’impression d’ensemble produite par cette combinaison (voir, par analogie, arrêt de la Cour du 11 novembre 1997, SABEL, C‑251/95, Rec. p. I‑6191, point 23), ce qui n’est pas incompatible avec un examen successif des différents éléments de présentation utilisés.
In order to ascertain whether the combination of the shape of the tablet at issue and its pattern may be perceived by members of the public as an indication of origin, the overall impression produced by that combination must be analysed (see, by analogy, Case C-251/95 SABEL [1997] ECR I‑6191, paragraph 23). That is not incompatible with an examination of each of the product’s individual features in turn.
