Le 29 mars et le 29 avril 2004, la Commission a envoyé ses observations aux autorités tchèques, en indiquant qu’il ne fallait pas exclure, sur la base des informations fournies, que l’acquisition des actions INH détenues par la société TŽ, prévue par le gouvernement tchèque, soit supérieure au prix du marché, ce qui impliquerait une aide d’État en faveur de la société TŽ, et en précisant également que l’aide d’État devant permettre le financement de divers projets de la société TŽ ne semblait pas compatible avec les règles communautaires applicables en matière d’aides d’État.

On 29 March and 29 April 2004 the Commission sent comments to the Czech authorities indicating that on the basis of the information provided it could not be excluded that the planned acquisition by the Czech Government of the INH shares held by TŽ would be done above the market price, thereby involving State aid in favour of the latter, and that State aid financing different TŽ projects did not seem to be compatible with the current Community State aid rules.
