At core, the Crown has always recognized these communities and most recently, in the Van der Peet case, Chief Justice Antonio Lamer commented that the reason the peoples have Indian or native title is not because it was given to them by the sovereign or the Crown, but rather it was recognition of their legal rights and interests which pre-existed the coming of the Europeans, and that this legal reality arises from one fact and one fact alone, that being that prior to the coming of the Europeans these peoples were living together in communities, in organized societies according to their own customs, laws and practices.
