For the purpose of point 3 of this Annex, governmental stockholding programmes for food security purposes in developing countries whose operation is transparent and conducted in accordance with officially published objective criteria or guidelines shall be considered to be in conformity with the provisions of this point, including programmes under which stocks of foodstuffs for food security purposes are acquired and released at administered prices, provided that the difference between the acquisition price and the external reference price is accounted for in the AMS.

4. Sales of the like product in the domestic market of the exporting country, or export sales to a third country, at prices below unit production costs (fixed and variable) plus selling, general and administrative costs may be treated as not being in the ordinary course of trade by reason of price, and may be disregarded in determining the normal value, only if it is determined that such sales are made within an extended period in substantial quantities, and are at prices which do not provide for the recovery of all costs within a rea ...[+++]sonable period of time.

to license all its rights in the Final Price for the purpose of exchange trading, clearing and/or settling of credit derivatives on fair, reasonable and non-discriminatory (FRAND) terms; to submit to a third-party arbitration procedure with binding effect in the event of a disagreement on the FRAND terms and conditions; to prevent investment banks from influencing ISDA's decisions on licensing the Final Price by transferring the responsibility for the decision to license from ISDA's Board of Directors to the Chief Executive Officer who must not seek the views of the banks; not to unilaterally terminate a Final Price license due to "au ...[+++]ction manipulation concerns" unless ISDA demonstrates these concerns to the satisfaction of a monitoring trustee and proves that no other less stringent measure could address this risk.

15'. advance pricing arrangement' means any agreement, communication or any other instrument or action with similar effects, including one issued in the context of a tax audit, given by, or on behalf of, the government or the tax authority of one or more Member States, including any territorial or administrative subdivision thereof, to any person that determines in advance of cross-border transactions between associated enterprises, an appropriate set of criteria for the determination of the transfer pricing for those transactions or determines the attribution of profits to a permanent establishment.
