Au regard du point (a) du premier alinéa, un fonds de capital-risque éligible n'est pas établi dans un pays tiers qui se présente comme un centre financier extraterritorial ou qui se caractérise par des taux d'imposition nuls ou insignifiants, par une absence d'échange efficace d'informations avec les autorités fiscales étrangères, par un manque de transparence des dispositions législatives, juridiques ou administratives, ou par l'absence d'obligations concernant une présence locale notable.
In regard to point (a) of the first subparagraph, a qualifying venture capital fund shall not be established in a third country which promotes itself as an off-shore financial centre or in which there are no or nominal taxes, a lack of effective exchange of information with foreign tax authorities, a lack of transparency in legislative, judicial or administrative provisions, or no requirement for a substantive local presence.
