Dans ce contexte, troisièmement, la Commission est en droit d’apprécier le caractère innovant de ces technologies par référence à ses composantes, à savoir la nouveauté et l’activité inventive, Microsoft n’ayant par ailleurs pas allégué qu’il est inconcevable d’apprécier l’activité inventive des technologies en cause dans un contexte différent de celui de l’octroi d’un brevet.
In that regard, third, the Commission is entitled to assess those technologies’ innovative character by reference to its constituent elements, namely novelty and inventive step, Microsoft in any event not having argued that the inventiveness of the technologies at issue cannot be assessed in a context other than that of a patent grant.
