The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in respect of technical adjustments to Directive 2006/48/EC to clarify definitions to ensure uniform application of that Directive or to take account of developments on financial markets; to align terminology on, and frame definitions in accordance with, subsequent relevant acts; to expand the content or adapt the terminology of the list of activities subject to mutual recognition under that Directive to take account of developments on financial markets; to adjust the areas in which the competent authorities are required to exchange informat ...[+++]ion; to adjust the provisions of that Directive on own funds to reflect developments in accounting standards or Union legislation, or with regard to the convergence of supervisory practices; to expand the lists of exposure classes for the purposes of the Standardised Approach or the IRB Approach to take account of developments on financial markets; to adjust certain amounts relevant to those exposure classes to take into account the effects of inflation; to adjust the list and classification of off-balance sheet items; and to adjust specific provisions and technical criteria on the treatment of counterparty credit risk, the organisation and treatment of risk, the Standardised Approach and the IRB Approach, credit risk mitigation, securitisation, operational risk, review and evaluation by the competent authorities and disclosure in order to take account of developments on financial markets or in accounting standards or Union legislation, or with regard to the convergence of supervisory practices.

The new member countries will increase the diversity of the national regulatory frameworks in the EU, underlying further the importance of a principles-based approach able to maintain a high level of legal certainty in intra-Community operations.

This approach builds on a framework of principles to achieve the wider development goals, and provides a strategy that will deliver sustainable transport which is safe, economically, financially and institutionally sustainable as well as environmentally sound and socially aware.

This right would make it possible for a manufacturer to prevent the non-authorized extraction and/or the re-utilization of the whole or a substantial part of the contents of a database - without prejudice, however, to application of the rules of competition (especially as regards the abuse of dominant positions and abusive practices. The protection granted by this right would apply for fifteen years after the completion of a database. The Member States would have the option of providing for certain exceptions to the sui generis right, in particular as regards extractions for private purposes or illustration in teaching. The Member States should transpose the Directive into their national legislation before 1 January 1998. CONVENTION ON INSOLVENCY PROCEEDINGS The Council - noted the agreement of fourteen delegations on the current draft text of the Convention; - instructed the Permanent Representatives Committee to continue its proceedings and seek bases for rapprochement such that unanimous agreement could be reached and to prepare the explanatory report awaited for final approval by the Council. The draft Convention is based on the principle of attenuated universality, i.e. on an approach based on main insolvency proceedings opened in the Contracting State in which a debtor has the centre of his main interests and the possibility of opening secondary or territorial proceedings wherever he is established. The main proceedings would produce effects in all the Contracting States and the territorial and secondary proceedings would produce effects restricted to the territory of the Contracting State where they were opened. This approach represents a compromise which endeavours to take into account the various legal traditions in the Member States.
