The transactions must take place on the initiative and under the responsibility of the administrative or management body at fair market conditions, especially with regard to interest received by the company from the third party and with regard to security provided to the company by the third party for the loans and advances referred to in paragraph 1.
Solche Geschäfte dürfen nur auf Initiative und unter der Verantwortung des Verwaltungs- oder Leitungsorgans stattfinden und müssen zu fairen, marktüblichen Konditionen abgewickelt werden, was insbesondere für die Zinsen, die die Gesellschaft von dem Dritten erhält, und die Sicherheiten, die der Dritte der Gesellschaft für die in Absatz 1 genannten Darlehen oder Vorschüsse stellt, gilt.
