The creation of an area of freedom, security and justice (AFSJ) is one of the objectives of the European Union (EU).

having regard to the public hearing organised by the European Parliament on 21 and 22 June 2010 on the impact of the Charter of Fundamental Rights in the development of a European area of freedom, security and justice (AFSJ),

Calls on the Commission to enforce the values and principles enshrined in the Treaty and Charter and the strategy set out in the Stockholm Programme through concrete legislative proposals while having regard to the jurisprudence of the ECtHR when carrying out these activities; furthermore, calls for the ‘Lisbonisation’ of the current acquis in the field of police and judicial cooperation and for a strengthening of democratic accountability in the AFSJ;

Calls for full and consistent implementation, in compliance with international and European human rights law, of the Stockholm Programme, which converts the obligations and principles deriving from the Treaty into practice by setting the strategic guidelines for the AFSJ;

Welcomes, furthermore, the new horizontal obligations created by the Treaty of Lisbon to combat social exclusion and discrimination and to promote social justice and protection, equality between men and women, respect for private and family life, solidarity between generations and protection of the rights of the child, and to develop a common policy on asylum and immigration and combat trafficking in human beings, as well as its explicit reference to persons belonging to minorities, which reflects another founding value of the Union; welcomes the fact that the Union has acquired legal personality allowing it to accede to international treaties, the improvement in judicial protection with the extension of the jurisdiction of the CJ to areas ...[+++] of obvious relevance to the protection of fundamental rights, such as police and judicial cooperation in the field of criminal law, the strengthened role of the European Parliament and national parliaments in the European decision-making process, especially in evaluating the implementation of EU policy in the AFSJ, the increased role of European citizens, now invested with the power to initiate EU legislation through the European Citizens’ Initiative, and the obligation to maintain an open, transparent and regular dialogue with representative associations and civil society (Article 11(2) TEU);

6. Proposes that the Commission establish a procedure for regular notification of the Committee on Civil Liberties, Justice and Home Affairs about external aspects of the AFSJ, in particular negotiations on agreements plus political dialogue with non-member countries and international organisations; calls on the Commission to finalise the "TRANS-JHA" pilot project, which should make it possible to monitor events and documents relating to AFSJ legislative procedures on a day-to-day basis, provided that such information and documents are accessible on the institutions" registers; calls on the national parliaments to take part in this pil ...[+++]ot project by making available on-line the preparatory work for each legislative procedure concerning the adoption or transposition of EU measures relating to the AFSJ;
