These practices are crippling to free competition, since many patents relate to software which de facto belongs to the public domain.

(16) The adoption of a public policy addressing speculative and abusive registration of domain names should provide that holders of prior rights recognised or established by national and/or Community law and public bodies will benefit from a specific period of time (a "sunrise period") during which the registration of their domain names is exclusively reserved to such holders of prior rights recognised or established by national and/or Community law and public bodies.

I hope the Minister of the Environment will work with the Minister of Transport to try to make this railway a reality, not in the public domain but in the private domain; ownership being retained in the public domain but management and functioning in the private sector.

By the time they had actually created and started that project, a lot of information which in the 1990s, when the project was conceived, was not in the public domain because the product monograph was not considered part of the public domain at the time, had been then relegated to the public domain by the time they started.

But in key areas of software and in biotechnology, we're getting major questions about an increasingly strong intellectual property system that is fencing off from the public domain key elements of what had normally been called science and knowledge that had been universal.
