As regards rural development support measures under Articles 28, 29, 33 and 34 of Regulation (EU) No 1305/2013, if a beneficiary has been unable to fulfil the commitment as a result of force majeure or exceptional circumstances, the respective payment shall be proportionally withdrawn for the years during which the case of force majeure or exceptional circumstances occurred.

We would also take this opportunity to applaud the government's commitment to improving labour market opportunities for Canadians living with disabilities, which is evidenced through the strengthened federal programming for persons with disabilities in Canada's economic action plan of 2013, the convening of the panel on labour market opportunities for persons with disabilities and its subsequent report, “Rethinking Disability in the Private Sector”, as well as the private member's motion M-430, introduced by MP Phil McColeman.

In consultation with bargaining agents under the disability management initiative, we have developed resources, tools and services for departments. These include training for disability management advisers and a web resource, which contains a manager's handbook, a manual on establishing a disability management program in departments and an employee wellness resource.

Member States may decide to further examine the application only if the applicant concerned was, through no fault of his/her own, incapable of asserting the situations set forth in paragraphs 3, 4 and 5 of this Article in the previous procedure, in particular by exercising his/her right to an effective remedy pursuant to Article 39.
