La Commission proposait initialement d'utiliser comme base juridique l'article 192 du traité sur le fonctionnement de l'Union européenne (traité FUE), c'est-à-dire la base juridique applicable aux politiques de l'Union en matière d'environnement, et l'article 207 du traité FUE sur la politique commerciale commune, combinés à l'article 218, paragraphe 6, point a), du traité FUE, c'est-à-dire la base juridique procédurale sur la conclusion des accords internationaux, en vertu de laquelle l'approbation du Parlement est requise.
The legal basis originally proposed by the Commission was Article 192 of the Treaty on the Functioning of the European Union (TFEU), the legal basis for the Union policy on the environment, and Article 207 TFEU on the common commercial policy, together with Article 218(6)(a) TFEU, the procedural legal basis on the conclusion of international agreements according to which the consent of Parliament is required.
