In the light of the case-law of the Court of Justice, such restrictions may be imposed only if they are necessary, proportionate and suitable to protecting the reputation of the designation of origin or geographical indication.

The fact of restricting the packaging of a wine sector product with a designation of origin or a geographical indication, or operations connected with the presentation of the product, to a defined geographical area constitutes a restriction on the free movement of goods and freedom to provide services.

10. Supports the decision of the Foreign Affairs Council of 23 January 2012 to adopt new restrictive measures and calls on stronger sanctions targeting Syrian regime to be taken on 27 February 2012 taking into consideration recent reports according to which the Syrian regime intends to counter restrictive measures particularly through cooperation with Iran;

1. Member States shall ensure the right to appeal against operating restrictions adopted pursuant to this Regulation before an appeal body other than the authority that adopted the contested restriction, in accordance with national legislation and procedures.

(22) Provisions should be adopted to ensure the right of appeal against the introduction of operating restrictions to an appeal body, which may be a court.
