3. Par dérogation au paragraphe 1, le commerce avec un État non partie au protocole de substances réglementées et de produits et équipements qui en contiennent ou qui en sont tributaires, ou qui sont fabriqués avec une ou plusieurs de ces substances, peut être autorisé par la Commission, pour autant qu’il soit reconnu, dans une réunion des parties, en vertu de l’article 4, paragraphe 8, du protocole, que l’État non partie au protocole s’est entièrement conformé au protocole et a fourni, à cet effet, les données visées à l’article 7 du protocole.
3. By way of derogation from paragraph 1, trade with any State not party to the Protocol in controlled substances and products and equipment containing or relying on such substances or which are produced by means of one or more such substances may be authorised by the Commission, to the extent that the State not party to the Protocol is determined by a meeting of the Parties pursuant to Article 4(8) of the Protocol to be in full compliance with the Protocol and has submitted data to that effect as specified in Article 7 of the Protocol.
