The submission of incorrect information should be discouraged by means of the application of an increase in the amount of the applicable fee in such circumstances.

For the purposes of calculating the risk-weighted exposure amount for this position, the provisions in points 52 to 54 shall apply subject to the modifications that "T" shall be adjusted to e* in the case of funded credit protection; and to T-g in the case of unfunded credit protection, where e* denotes the ratio of E* to the total notional amount of the underlying pool, where E* is the adjusted exposure amount of the securitisation position calculated in accordance with the provisions of Annex VIII as they apply for the calculation of risk-weighted exposure amounts under Articles 78 to 83 taking the amount of the securitisation positio ...[+++]n to be E; and g is the ratio of the nominal amount of credit protection (adjusted for any currency or maturity mismatch in accordance with the provisions of Annex VIII) to the sum of the exposure amounts of the securitised exposures.

That is not to say that, come our second reading, the figure may well be EUR 47.5 million but, for the sake of this debate and to clarify issues, our argument is that the Council put the wrong figure in: it should be EUR 30 million.

The only reason we voted for Amendment No 7 to the Lage report and Amendment No 5 to the Cunha report is because at least they have the merit of formally specifying the amount of financial compensation, without making any advance judgment on the question of whether this sum really makes up for the loss of this natural resource.

(10) Under Article 14(1)(c) of the Merger Regulation, the Commission may by decision impose fines of from EUR 1000 to EUR 50000 on undertakings which, intentionally or negligently, supply incorrect information in response to a request made pursuant to Article 11 of the Merger Regulation or which fail to supply information within the period fixed by a decision pursuant Article 11.
