Se fondant sur les exigences qui découlent de la jurisprudence pour déterminer si la contribution de l’État grec au coût du RPV de l’OTE peut être assimilée au comportement d’un investisseur privé agissant dans les conditions normales du marché, il est nécessaire d’examiner si, dans des cas semblables, un investisseur privé d’une taille comparable à celle de l’État pourrait proposer une contribution d’un tel montant, à savoir 4 % des actions de l’OTE (31).
In line with the requirements arising from the case-law, in order to determine whether the Greek State’s financial contribution towards the costs of OTE’s VRS can be regarded as being in line with the behaviour of a private investor acting under normal market conditions, it is necessary to consider whether in similar circumstances a private investor of a size comparable to that of the State might have provided a similar financial contribution, namely the equivalent of 4 % of OTE’s shares (31).
