If no representative exists or if the insurer plays possum, the compensation body, on effecting payment in the victim's home country, would have an automatic right of redress against its counterpart in the defaulting insurer's country; if the insurer proves impossible to identify, the guarantee fund in the Member State in which the vehicle is usually kept would be responsible for compensating the victim.
