Les consultations ont également révélé que, outre la charge administrative, ce sont justement aussi les incertitudes et les méprises, en ce qui concerne notamment les notions clés sous-tendant les règles en matière d'aides d'État applicables aux SIEG, comme le mandat, les bénéfices raisonnables, les entreprises, les services économiques et non économiques ou les services relevant du marché intérieur qui ont pu contribuer à la non application des règles.
It also emerged from the consultation that, apart from the administrative burden, other factors possibly militating against application of the rules on state aid to SGEI have been uncertainties and misinterpretations, especially of key concepts in the rules, such as ‘act of entrustment’, ‘reasonable return’, ‘undertaking’, ‘economic and non-economic services’ and ‘internal market relevance’.
