À vrai dire, tant les postulats moraux, particulièrement celui qui veut que violence faite aux enfants peut servir à leur éducation, que la justification juridique, la non-reconnaissance du principe de l'intérêt supérieur de l'enfant, la répudiation de ses propres principes d'interprétation en ce qui a trait au droit international, ainsi que l'utilisation de cette technique de l'interprétation atténuée — sur lesquels se fonde cette décision — m'apparaissent en porte-à-faux avec les principes judiciaires établis par la Cour suprême du Canada.
In fact, the moral premises, particularly the argument that violence against children can contribute to their education, as much as the legal justification, the non- recognition of the principle of the child's best interest, the repudiation of its own principles of interpretation regarding international law, as well as the use of the attenuated interpretation technique — on which this decision is based — all seem to me to be completely at odds with the legal principles established by the Supreme Court of Canada.
