2. Le traitement prévu au paragraphe 1 n'est autorisé que lorsque l'établissement de crédit mère prouve de façon circonstanciée aux autorités compétentes l'existence des conditions et dispositions, y compris des dispositions juridiques, en vertu desquelles il n'existe, en droit ou en fait, aucun obstacle significatif, actuel ou prévu, au transfert rapide de fonds propres ou au remboursement, à l'échéance, de passifs par la filiale à son entreprise mère.
2. The treatment in paragraph 1 shall be allowed only where the parent credit institution demonstrates fully to the competent authorities the circumstances and arrangements, including legal arrangements, by virtue of which there is no material practical or legal impediment, and none are foreseen, to the prompt transfer of own funds, or repayment of liabilities when due by the subsidiary to its parent undertaking.
