Participating in a semi-military style uniformed association which apparently gave the impression that it would seek to achieve its objectives through the potential or actual use of the force is clearly contradictory and incompatible with the role and the responsibilities of a parliamentary mandate and cannot therefore be regarded as the legitimate exercise of the freedom of speech and, in general, as the normal performance of the duties of members belonging to an elected assembly representing citizens.

A minimal approach would be to regulate the following aspects: conditions in which these penalties may be imposed; duration of the penalty, with a possible indication of a minimum and/or a maximum period; conditions of implementation; the nature of the work to be done which, like the practical arrangements for community service, may differ according to the offence committed (for example hospital work for a person who has caused grievous bodily harm or work in old people's home for a young person who has attacked an elderly person); monitoring of alternative sanctions; penalties for failure to respect the conditions imposed for their ...[+++] implementation and, finally, as regards probation, the consequences of not abiding by the conditions set.

The Commission will also look at the possibility of introducing specific provisions into Community law to govern "functional claims" (relating, for example, to the beneficial effects of a nutrient on certain normal bodily functions) and "nutritional claims" (which describe, for example, the presence, absence or level of a nutrient or its value compared with similar foodstuffs), as well as provisions offering appropriate means of redress.

30. More generally, according to the case law of the Court of Justice [14], many activities conducted by organisations performing largely social functions, which are not profit-oriented and which are not meant to engage in industrial or commercial activity, will normally be excluded from the Community competition and internal market rules.
