Arrested in France on 28 September 2012, Mr F. expressly declared, before the Cour d’appel de Bordeaux (Bordeaux Court of Appeal), that he consented to his surrender to the judicial authorities of the United Kingdom but did not renounce the speciality rule, under which a person who has been the subject of an arrest warrant may not be prosecuted, sentenced or detained for any offence committed prior to his or her surrender other than that for which he or she was surrendered.

Pursuant to Article 32 of the framework decision on the European arrest warrant and the surrender procedures between Member States, France states that as executing Member State it will continue to deal with requests relating to acts committed before 1 November 1993, the date of entry into force of the Treaty on European Union signed in Maastricht on 7 February 1992, in accordance with the extradition system applicable before 1 January 2004.

However, any Member State may, at the time of the adoption of this Framework Decision by the Council, make a statement indicating that as executing Member State it will continue to deal with requests relating to acts committed before a date which it specifies in accordance with the extradition system applicable before 1 January 2004.

Italy will continue to deal in accordance with the extradition rules in force with all requests relating to acts committed before the date of entry into force of the framework decision on the European arrest warrant, as provided for in Article 32 thereof.

A person who has been extradited may, in respect of offences committed before his surrender other than those upon which the request for extradition was based, without it being necessary to obtain the consent of the requested Member State, be prosecuted or tried if this entails no deprivation of liberty.

We now move on to Group No. 10, Motion No. 65. [English] Hon. Fred Mifflin (Minister of Fisheries and Oceans, Lib) moved: Motion No. 65 That Bill C-26 be amended by adding after line 43, on page 25, the following new Clause: ``39.12 (1) In addition to the procedures set out in the Criminal Code for commencing a proceeding, proceedings in respect of any offence prescribed by the regulations may be commenced by an enforcement officer (a) completing a ticket that consists of a summons portion and an information portion; (b) delivering the summons portion to the accused or mailing it to the accused at the accused's latest known address; and (c) filing the information portion with a court of competent jurisdiction before the summons portion h ...[+++]as been delivered or mailed or as soon as is practicable afterward (2) The summons and information portions of the ticket must (a) set out a description of the offence and the time and place of its alleged commission; (b) include a statement, signed by the enforcement officer who completes the ticket, that the officer has reasonable grounds to believe that the accused committed the offence; (c) set out the amount of the fine prescribed by the regulations for the offence and the manner in which and period within which it may be paid; (d) include a statement that if the accused pays the fine within the period set out in the ticket, a conviction will be entered and recorded against the accused; and (e) include a statement that if the accused wishes to plead not guilty or for any other reason fails to pay the fine within the period set out in the ticket, the accused must appear in the court on the day and at the time set out in the ticket (3) Where a thing is seized under this Act and proceedings relating to it are commenced by way of the ticketing procedure, the enforcement officer who completes the ticket shall give written notice to the accused that, if the accused pays the fine prescribed by the regulations within the period s ...
