8. Any person that, during a calendar year, exports or imports a Schedule 1 chemical under an authorization referred to in subsection 8(2) of the Act must make, no later than February 28 of the following year, an annual declaration of the calendar year’s activities to the National Authority that is signed and dated by the declarant or, in the case of a corporation, by its authorized representative and that contains the following information:

(14) In order to achieve the objectives of Regulation (EC) No 111/2005, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in order to lay down provisions determining cases where a licence is not required and to set out further conditions for granting licences, to establish the conditions for exemptions from the controls of certain categories of operators and of operators engaged in the export of small quantities of scheduled substances listed in Category 3, to establish the criteria to determine how the licit purposes of the transaction may be demonstrated, to determine the information ...[+++] that is required by the competent authorities to monitor export, import or intermediary activities of operators, to determine the countries of destination to which exports of scheduled substances of Category 2 and 3 of the Annex should be preceded by a pre-export notification, to determine simplified pre-export procedures and to establish the common criteria thereof, to determine the countries of destination to which exports of scheduled substances listed in Category 3 of the Annex should be subject to an export authorisation, to determine simplified export authorisation procedures and to establish the common criteria thereof, and to introduce additional substances into the Annex to this Regulation, as well as other amendments necessary to respond to new trends of drug precursor diversion.

4. Regrets that the investment climate in China lacks transparency and that discriminatory requirements still exist; calls for a bilateral investment agreement with China, aiming at increased market access for investments, starting with the most restricted sectors; emphasises the need to facilitate trade and investment, especially for SMEs; points out the importance of coordination between central and local authorities in China; highlights the fact that China is the largest source of imports for the EU and is the EU’s second-largest ...[+++]export market, with both imports and exports having increased by over 30 per cent between 2009 and 2010;

The two amending acts concerned are Commission Regulation (EU) No 186/2011 of 25 February 2011 amending Annex I to Regulation (EC) No 689/2008 of the European Parliament and of the Council concerning the export and import of dangerous chemicals and Commission Regulation (EU) No 214/2011 of 3 March 2011 amending Annexes I and V to Regulation (EC) No 689/2008 of the European Parliament and of the Council concerning the export and import of dangerous chemicals.

The Commission was authorised by the Council to negotiate and sign the UNFP in 2002 on behalf of the European Community. In its communication of 18 July 2005 the Commission signalled its intention to complete the ratification process by transposing the provisions of Article 10 UNFP on ‘general requirements for export, import and transit licensing or authorisation systems’.

(1) Council Regulation (EEC) No 2455/92 of 23 July 1992 concerning the export and import of certain dangerous chemicals establishes inter alia a common system of notification and information for exports to third countries of chemicals which are banned or severely restricted in the Community on account of their effects on human health and the environment.
