Emphasises that any commercial exploitation of organs that denies equitable access to transplantation is unethical, is inconsistent with the most basic human values, contravenes Article 21 of the Convention on Human Rights and Biomedicine and is prohibited under Article 3(2) of the EU Charter on Fundamental Rights;

49. Points out that there is a link between organ shortage and organ trafficking, in that organ trafficking undermines the credibility of the system for potential voluntary and unpaid donors; emphasises that any commercial exploitation of organs is unethical and inconsistent with the most basic human values; stresses that organ donation motivated by financial considerations degrades the gift of an organ to a mere commodity, thus constituting a violation of human dignity and contravening Article 21 of the Convention on Human Rights and Biomedicine and is prohibited under Article 3(2) of the Charter on Fundamental Rights of the ...[+++] European Union;

B. whereas the European Parliament has already agreed to the adaptations made to the Charter of Fundamental Rights as originally solemnly proclaimed in Nice on 7 December 2000, when, in its above-mentioned resolution of 24 September 2003, it assessed the results of the work of the Convention on the Future of Europe and when, in its above-mentioned resolution of 12 January 2005, it approved the Constitutional Treaty resulting from the work of the 2004 Intergovernmental Conference (IGC),

Finally, a word on a related subject, but one which I know to be of fundamental importance for the European Parliament: the Charter of Fundamental Rights. I can tell you that the European Council unanimously commended the quality of this text, which can therefore be formally proclaimed at Nice in the form that it was transmitted by the Convention.

4. A further plenary meeting of the Convention is scheduled for 2 October 2000, in order to declare formally the existence of a consensus meeting the requirements set out in the mandate given by the Tampere European Council and the decision to present the consolidated text to the European Council to be held in Biarritz later that month.

The Hague Convention formally enshrines this principle and stipulates that the authorities of the state of origin have exclusive responsibility for ensuring compliance, given that they are in the best position to do so.
