A. whereas following the attacks on Coptic churches in March, May and September 2011, and the absence of satisfactory response from local and national authorities to effectively prosecute the perpetrators of the attacks, in particular in the Southern Aswan Governorate, a peaceful march mainly from the Coptic community was staged in Cairo on 9 October in order to call on Egyptian authorities to take all necessary steps to arrest and prosecute the perpetrators and the instigators of the attacks on the Church, to adopt a unified law for building houses of worship, to effectively criminalise religious discrimination and to rebuild the church that was attacked; whereas ...[+++] this protest chanted against the regime and turned into a bloodbath that caused the death of 27 civilians and possibly up to three soldiers as well as to more than 300 hundreds wounded, the worst violence Egypt has seen since ousting of Mubarak in February;

5. Calls on the European Union and its Member States to support calls for independent investigations into the attacks against protestors in those countries, with special regard to an independent investigation to be carried out by the United Nations (UN) or the International Criminal Court into the attack on protestors on 18 March 2011 in Sana'a, Yemen, where 54 people were killed and more than 300 were injured; calls on the EU to immediately take the lead in convening a Special Session of the HRC to address abuses committed in Bahrain, Syria and Yemen during the crackdown on demonstrations and repression of dissent;

The Commission takes the view that the General Court, in paragraph 174 of the judgment under appeal, rightly held that in-house lawyers and external lawyers are clearly in very different situations, owing, in particular, to the personal, functional, structural and hierarchical integration of in-house lawyers within the companies that employ them.

Subsequently, after considering and allowing the first plea put forward by Mr Meierhofer, alleging breach of the obligation to state reasons (paragraphs 30 to 55 of the judgment under appeal, the Civil Service Tribunal annulled the decision of 19 June 2007 and ordered the Commission to pay the costs, while rejecting the other heads of claim on the ground that the Community judicature manifestly has no jurisdiction to issue directions to the Community institutions.
