Selon ces règles, lorsqu’un pouvoir adjudicateur ou une entité adjudicatrice concluent un accord-cadre conformément aux dispositions de la présente directive notamment concernant la publicité, les délais et les conditions de remise des offres, ils peuvent, pendant la durée de cet accord-cadre, conclure des marchés basés sur cet accord-cadre soit en appliquant les clauses fixées dans celui-ci, soit, lorsque toutes les clauses n’ont pas été fixées à l’avance, après avoir remis en concurrence les parties à l’accord-cadre.
Under these rules, when a contracting authority/entity enters into a framework agreement in accordance with the provisions of this Directive relating, in particular, to advertising, time-limits and conditions for the submission of tenders, it may enter into contracts based on this framework agreement during its term of validity either by applying the terms set forth in the framework agreement or, if not all terms have been fixed in advance, by reopening competition between the parties to the framework agreement.
