L'Italie, elle, a été condamnée par la Cour pour ne pas permettre, contrairement au droit communautaire, aux avocats ressortissants d'autres États membres de disposer dans cet État de l'infrastructure nécessaire à l'accomplissement de leurs prestations, pour les obliger à continuer à résider dans l'arrondissement du tribunal dont dépend le barreau auquel ils sont inscrits afin de ne pas avoir à transposer de manière complète la directive 89/48 relative à un système général de reconnaissance des diplômes.
The Court also ruled against Italy for failing to comply with Community law and allow lawyers who are nationals of other Member States to make use of the infrastructure in Italy required for carrying out their duties, and requiring them to continue to reside in the judicial district of the court to which the Bar at which enrolment is sought is attached so as not to have to transpose fully Directive 89/48 on a general system for the recognition of diplomas.
