Immediately after the entry into force of this Regulation, the President of the European Parliament shall choose by lot, from amongst the members of the Supervisory Committee, two members whose duties are to end, by way of derogation from the first sentence of Article 15(3), upon expiry of the first 36 months of their term of office.

The president of the Council shall proceed to choose by lot the judges whose terms of office are to expire at the end of the first three years which had also been foreseen for the Court of First Instance in Article 12 of Council Decision 88/591/ECSC, EEC, Euratom of 24 October 1988 establishing the Court of First Instance.

To that end, the present decision contains in its Article 7(2) a transitory provision whereby the president of the Council is to proceed to choose by lot the judges whose terms of office are to expire at the end of the first three years.
