Le 20 septembre 2001, la Cour a confirmé cette approche: «une aide consiste en un allégement des charges qui pèsent normalement sur le budget des entreprises compte tenu de la nature ou de l’économie du système de charges en cause, tandis qu’une charge spéciale est au contraire une charge supplémentaire par rapport à ces charges normales» (187).
On 20 September 2001, the Court reaffirmed that approach: ‘an aid consists of a mitigation of the charges which are normally included in the budget of an undertaking, taking account of the nature or general scheme of the system of charges in question, whereas a special charge is, on the contrary, an additional charge over and above those normal charges’ (187).
