[33] The Commission reported in February 2012 on cases of judges at the High Court of Cassation and Justice who continue to sit in court while under investigation for high-level corruption.

Since 2007 a number of MPs, including a former Prime Minister, have been shielded from criminal investigation by the Parliament’s refusals to allow the opening of criminal investigations.[47] The fact that Parliament does not motivate refusals to allow the opening of criminal investigations makes it difficult to establish the objectivity of decisions.[48] In addition, the fact that parliamentarians can still sit whilst also convicted of serious offences like corruption damages the reputation of Parliament – many parliamentary systems have the practice of suspending parliamentarians at indictment in such cases, and exclusion on conviction ...[+++].[49]

If, in addition, none of the members appointed by the Management Board is in a position to hear a case, additional members should be appointed to the Board of Appeal on an ad hoc basis and promptly.

The proposal provides for: (a) broader participation by the Judges in cases assigned to the Grand Chamber, allowing them to sit far more frequently than at present. That would be achieved by amending Articles 16 and 17 of the Statute so as to increase to 15 the number of Judges constituting the Grand Chamber and to end the automatic participation of all the Presidents of five-judge Chambers in Grand Chamber cases.
