Health, which has a huge growth potential for innovative products and services (including in particular e-Health, and the provision of customized solutions to allow elderly people to continue to live independently, pharmaceuticals and medical devices where innovation can bring direct benefits to patients and improve competitiveness), or well-being and culture (for instance creative content services, which gain a new dimension with the rollout of broadband networks, allowing citizens and businesses to access all kind of creative contents such as audiovisual, games, cultural information at home and in mobility) are examples of markets where the public sector has a role to play.

The most frequently reported practices mentioned by respondents to the consultation involve untruthful information on the main characteristics and/or on the price of the product or service offered for sale in the areas of internet and telecommunication services (e.g. broadband speed), financial services (e.g. consumer credit, life insurance), tourism (e.g. accommodation services including credit card fees in respect of hotels, time ...[+++]share and related products), air transport and e-commerce.

Under Directive 92/44/EEC, Member States must ensure that the telecommunications organizations make available certain types of leased lines to all providers of telecommunications services. However, the Directive provides only for such offer of a harmonized set of leased lines up to a certain bandwidth. Companies needing a higher bandwidth to provide services based on new high-speed technologies such as SDH (synchronous digital hier ...[+++]archy) have complained that the telecommunications organizations concerned are unable to meet their demand whilst it could be met by the optic fibre networks of other potential providers of telecommunications infrastructure, in the absence of the current exclusive rights. Consequently, the maintenance of these rights delays the emergence of new advanced telecommunications services and therefore restricts technical progress at the expense of the users contrary to Article 90 (1) of the Treaty, in conjunction with point (b) of the second paragraph of Article 86 of the Treaty.
