The paper groups the issues into six themes;

Moreover, in some areas the technicalities of the solutions would have to be refined further, for instance as regards the allocation formula, double taxation treaty issues, tax incentives, opt-in and opt-out clauses for companies, record keeping and the link to company law requirements (e.g. concerning financial accounts).

This body, which can be the Ministry responsible for transport matters or any other body, shall be independent in its organisation, funding decisions, legal structure and decision-making from any infrastructure manager, charging body, allocation body or applicant.

2. At the request of a Member State or on its own initiative the Commission shall, in a specific case, examine the application and enforcement of provisions concerning charging, capacity allocation and safety certification, and within two months of receipt of such a request decide in accordance with the advisory procedure referred to in Article 35(2) whether the related measure may continue to be applied.
