The data subject can enforce against the sub-processor this Clause, Clause 5(a) to (e) and (g), Clause 6, Clause 7, Clause 8(2), and Clauses 9 to 12, in cases where both the data exporter and the data importer have factually disappeared or ceased to exist in law or have become insolvent, unless any successor entity has assumed the entire legal obligations of the data exporter by contract or by operation of law as a result of which it takes on the rights and obligations of the data exporter, in which case the data subject can enforce t ...[+++]hem against such entity.

3. If, within two months of receiving the notification referred to in paragraph 2, the other party does not accept that the contested decision is to be rectified and makes a declaration to that effect or does not make any declaration within the period laid down, the appeal shall be remitted to the Board of Appeal without delay, and without comment as to its merit.

Reference may be made to the Commission by any Contracting Party (Article 24), and the Commission may receive petitions from any person, non-governmental organization or group of individuals (Article 25) provided that the State against which the complaint has been lodged has expressly recognized this individual right of redress.1 The Commission of Human Rights first has to consider whether a petition is admissible.
