Selon la Commission, cette opération aurait incité Tetra Laval à se servir de sa position dominante sur le marché des emballages carton pour persuader ses clients sur ce marché, qui passent au PET pour certains produits sensibles (lait, jus de fruits, boissons non gazeuses, boissons au thé et au café) d'opter pour les machines SBM de Sidel, et aurait transformé de ce fait la prééminence de Sidel en position dominante.
According to the Commission, that merger would have encouraged Tetra Laval to use its dominant position on the carton-packaging market to persuade its customers on that market who are switching to PET for certain sensitive products (milk, fruit juices, still drinks, tea and coffee drinks) to choose Sidel's SBM machines and would thereby have turned Sidel's leading position into a dominant position.
