To us, at first glance, this looks like an advancement of the animals rights movement rather than simply an attempt to eliminate wanton cruelty to animals.

Welcomes, furthermore, the new horizontal obligations created by the Treaty of Lisbon to combat social exclusion and discrimination and to promote social justice and protection, equality between men and women, respect for private and family life, solidarity between generations and protection of the rights of the child, and to develop a common policy on asylum and immigration and combat trafficking in human beings, as well as its explicit reference to persons belonging to minorities, which reflects another founding value of the Union; welcomes the fact that the Union has acquired legal personality allowing it to accede to international t ...[+++]reaties, the improvement in judicial protection with the extension of the jurisdiction of the CJ to areas of obvious relevance to the protection of fundamental rights, such as police and judicial cooperation in the field of criminal law, the strengthened role of the European Parliament and national parliaments in the European decision-making process, especially in evaluating the implementation of EU policy in the AFSJ, the increased role of European citizens, now invested with the power to initiate EU legislation through the European Citizens’ Initiative, and the obligation to maintain an open, transparent and regular dialogue with representative associations and civil society (Article 11(2) TEU);

In the interests of the animals, and provided it does not affect the functioning of the internal market, it is appropriate to allow the Member States certain flexibility to maintain national rules aimed at more extensive protection of animals in so far as they are compatible with the TFEU.

Therefore, the terms of protection of copyright and related rights established by Community law cannot have the effect of reducing the protection enjoyed by rightholders in the Community before the entry into force of Directive 93/98/EEC.

In order to establish a high level of protection which at the same time meets the requirements of the internal market and the need to establish a legal environment conducive to the harmonious development of literary and artistic creation in the Community, the term of protection for copyright should be harmonised at 70 years after the death of the author or 70 years after the work is lawfully made available to the public, and for related rights at 50 years after the event which sets the term running.

The Parties agree that for the purpose of the Agreement, intellectual, industrial and commercial property includes in particular copyright, including the copyright in computer programmes, and neighbouring rights, the rights relating to databases, the rights relating to patents, industrial designs, geographical indications, including designations of origin, trademarks and service marks, topographies of integrated circuits, as well as protection against unfair competition as referred to in Article 10 bis of the Paris Convention for the Protection of Industrial Property and protection of undisclosed information on know-how.
