F. considérant que, si la directive 98/44/CE légifère sur les inventions biotechnologiques, et notamment le génie génétique, l'intention du législateur – comme l'indiquent les considérants 52 et 53 – n'était toutefois pas d'inclure la brevetabilité des produits obtenus par des procédés essentiellement biologiques dans le champ d'application de la directive;
F. whereas Directive 98/44/EC legislates for biotechnological inventions, in particular genetic engineering, but whereas – as indicated in recitals 52 and 53 thereof – it was not the legislator’s intention to allow the patentability of products obtained from essentially biological processes within the scope of the directive;
