There are more options for the police to enforce disposition orders and assessment orders that take into account the need for the accused's treatment to continue.

As is the case in the Convention between the Member States of the European Communities on the enforcement of foreign criminal sentences of 13 November 1991, the State of enforcement has two options as to the manner of enforcement: the relevant authorities of the State of enforcement must either proceed to immediate enforcement of the sentence or convert the sentence, through a judicial or administrative procedure, into a decision of that State, thereby substituting for the penalty imposed in the sentencing State a penalty prescribed by the law of the administering State for the same offence (Article 9).

As regards grounds for refusal, the Council agreed on a consultation mechanism between Member States before the executing State decides not to recognise or execute a confiscation order when it falls outside the scope of the option adopted by the executing State under the draft Framework Decision on confiscation of crime-related proceeds, instrumentalities and property.

In most situations cross-border transfers within the euro area should be therefore also executed by default as SHARE (no other cost option should be proposed to customers).[6]

Senator Banks: As a practical matter in the short term, a quick and relatively — by comparison with the other options — inexpensive way to obtain an enforcement capability for Canada, in that space between the deep sea and the coast, would be to give the constabulary role to the Coast Guard with the ships that it now has?
