Since the objectives of the action to be taken, namely the establishment and regulation of a joint information system, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the action, be better achieved at the level of the European Union, the Council may adopt measures in accordance with the principle of subsidiarity, as set out in Article 5 of the EC Treaty and referred to in Article 2 of the EU Treaty. In accordance with the principle of proportionality, as set out in Article 5 of the EC Treaty, this Decision does not go beyond what is necessary to achieve those objectives.

Measures taken under this Regulation in pursuit of the objectives of Articles 177 and 181a of the Treaty establishing the European Community (hereinafter referred to as ‘the EC Treaty’) may be complementary to and should be consistent with measures adopted by the EU in pursuit of Common Foreign and Security Policy objectives within the framework of Title V and measures adopted within the framework of Title VI of the Treaty on European Union (hereinafter referred to as ‘the EU Treaty’).

(1) CONSIDERS that the maintaining and developing of the Union as an area of freedom, security and justice as laid down in Article 2 of the Treaty on European Union and the creation of the high level of safety in this area which is the general objective of Article 29 of the Treaty depends on the possibility to carry out criminal investigations and prosecutions sufficiently, thoroughly and effectively, while respecting human rights and fundamental freedoms as laid dow n in Article 6 of the Treaty on European Union.

It is subdivided into three parts: principles and objectives, dealt with in sections 4 and 5; warnings, cautions and referrals, in sections 6 to 9; and extrajudicial sanctions, in sections 10 to 12.

THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, Having regard to the Green Paper on the development of the single market for postal services, published on 11 June 1992; Having regard to the communication from the Commission on guidelines for the development of Community postal services; Whereas the development of postal services is an important feature of the development of the single market for the promotion of the economic and social development of the Community and its Member States; Whereas the provisions of the Treaty on the freedom to provide services cover the postal sector; Whereas the Green Paper and the abovementioned communication identify the aspects of postal services whic ...[+++]h are of Community interest; Whereas in view of these aspects it appears that efforts should be made at Community level to improve the efficiency and quality of postal services; Whereas the Commission has undertaken broad public consultation and has received contributions from interested parties in the postal sector; Whereas it is necessary to fix the main objectives of the development of postal services in the Community, in accordance with the Treaty; 1. GIVES ITS SUPPORT: to the general approach contained in the Commission's Green Paper on the development of the single market for postal services; 2. TAKES NOTE OF: the consultation which took place between the interested parties and the resulting Commission communication on the guidelines for developing Community postal services, certain aspects of which nevertheless remain to be considered in detail with a view to reaching an overall agreement; 3. REAFFIRMS: that a political agreement with the full participation of both the European Parliament and the Council is the best way of encouraging the implementation of the future Community policy in the postal sector; 4. ELIGIBLE PROJECTS The Fund may provide support for: - environmental projects, contributing to the achievement of the objectives of Article 130r of the Treaty, including projects resulting from measures adopted pursuant to Article 130s of the Treaty; - transport infrastructure projects which contribute to the achievement of the objectives of Article 129b of the Treaty and are consistent with Community priorities and guidelines, in particular those which will be implemented pursuant to Article 129c of the Treaty; - preparatory studies and technical support measures, related to eligible projects.
