(3) An employee whose wages are calculated on any basis other than a basis mentioned in subsection (1) or (2) shall, for a general holiday on which the employee does not work, be paid at least the equivalent of the wages the employee would have earned at his regular rate of wages for his normal working day.

Considers the sector to be characterised by considerable flexibility, with fixed-term contracts and the use of temporary agency workers; considers also that this sector tends to require workers to work on Sundays and public holidays, including evening and night work, which could have a negative impact on workers’ health and work-life balance; notes the importance of promoting a healthy work-life balance, and consequently calls on Member States to adjust their policies in relation to working on Sundays and public holidays in the retail sector, in order to promote a healthy work-life balance for workers without unduly negatively affe ...[+++]cting SMEs in the sector; calls on Member States and the social partners strongly to consider implementing policies that would regard Sunday work as always being voluntary, adequately paid and balanced by compensatory time off,, with exceptions having to be sufficiently justified;

On the one hand, we are proclaiming better reconciliation of work and family in order to improve the birth rate, which has been falling for years, and on the other hand we are letting Sundays and public holidays degenerate increasingly into normal working days – whereby traditions and family life inevitably fall by the wayside.

To reimburse a day’s expenses for a public holiday would result in the electorate staying at home in even greater numbers at the next elections.

the level of interest for late payment ('the statutory rate'), which the debtor is obliged to pay, shall be the sum of the interest rate of the main refinancing facility of the European Central Bank (ECB) in the form of two-week-tenders at fixed interest rates in force on the first ECB business day of the half-year in question ('the reference rate'), plus at least 6 percentage points ('the margin'), unless otherwise specified in the contract.
