For infractions described in (a), (b), (c), (d), (f), and (g), a Party will be deemed to have provided such concurrence if it does not object to the IRP within six months of a referral of a possible violation from the IRP.

For the infraction described in (e), a Party will be deemed to have provided such concurrence if it does not object to the IRP within 12 months of such referral.

3. By virtue of this Decision, Member States are presumed have given their consent, unless they make an explicit declaration to the contrary when the joint investigation team is created, that all information lawfully obtained by a member or seconded member of a joint investigation team set up under Framework Decision 2002/465/JHA, may be used for detecting, investigating and prosecuting terrorist offences involving any of the listed persons, groups or entities, pursuant to Article 1(10)(b) of Framework Decision 2002/465/JHA.

3. By virtue of this Decision, Member States are presumed have given their consent (unless they make an explicit declaration to the contrary when the joint investigation team is created) that all information lawfully obtained by a member or seconded member of a joint investigation team set up under the Framework Decision of 13 June 2002, may be used for detecting, investigating and prosecuting terrorist offences involving any of the listed persons, groups or entities, pursuant to Article 1(10)(b) of the Framework Decision of 13 June 2002.
