L'application de règles divergentes en matière de responsabilité civile pour les infractions à l'article 101 ou 102 du traité sur le fonctionnement de l'Union européenne et pour les infractions aux règles du droit national de la concurrence, lequel doit s'appliquer dans les mêmes affaires parallèlement au droit de la concurrence de l'Union, nuirait à la position des demandeurs dans ladite affaire et à l'étendue de leur demande, et constituerait un obstacle au bon fonctionnement du marché intérieur.
Applying differing rules on civil liability in respect of infringements of Article 101 or 102 TFEU and in respect of infringements of rules of national competition law which must be applied in the same cases in parallel to Union competition law would otherwise adversely affect the position of claimants in the same case and the scope of their claims, and would constitute an obstacle to the proper functioning of the internal market.
