As mentioned in section 2.4 of this Report, by virtue of Article 3(9)[105] of the UCPD, minimum harmonisation applies in the fields of financial services and immovable property.[106] Under Article 18 of the UCPD, the Commission is to report on the application of the Directive in these sectors and consider, in particular, whether the exemption from full harmonisation contained in Article 3(9) should be kept.
