(b)title transfer financial collateral arrangements under which collateral to secure or cover the performance of specified obligations is provided by a transfer of full ownership of assets from the collateral provider to the collateral taker, on terms providing for the collateral taker to transfer assets if those specified obligations are performed.

To that tune, ACE Aviation Holdings, the holding company created for the purpose of spinning out the former wholly-owned subsidiaries of Air Canada and tearing their asset value out — the full beneficial ownership resident in the shareholders of ACE Holdings — has announced just this week that they plan their final distribution to their shareholders of some $300 million, which represents the last vestiges of what Air Canada once was.

This applies to the full ownership of ores and source materials and to the right to use and consume special fissile materials.

(27) Where a client, in line with Community legislation and in particular Directive 2002/47/EC of the European Parliament and of the Council of 6 June 2002 on financial collateral arrangements(12), transfers full ownership of financial instruments or funds to an investment firm for the purpose of securing or otherwise covering present or future, actual or contingent or prospective obligations, such financial instruments or funds should likewise no longer be regarded as belonging to the client.
